John Rich Concert Official Rules

IMPORTANT: NO CONTRIBUTION, PURCHASE, OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW. By participating in this Promotion, you agree to be bound by these Official Rules and represent that you satisfy all eligibility requirements. Open only to citizens and permanent residents (green card holders) of the United States who are legal residents of one of the fifty states, Puerto Rico, or the District of Columbia and who are at least 18 years of age or the age of majority as determined by state law. Subject to all federal, state, and local laws, regulations, and ordinances.

  2. SPONSOR:The Sponsor is Blackburn Tennessee Victory Fund, P.O. Box 3750, Brentwood, TN 37024. Sponsor is a federal joint fundraising committee authorized by and composed of Marsha for Senate, Making a Responsible Stand for Households in American (MARSHA) PAC, and the Tennessee Republican Party Federal Election Account. 
  3. ELIGIBILITY:ALL FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS REGARDING THE ELIGIBILITY OF ENTRANTS APPLY. THE PROMOTION IS OPEN TO CITIZENS AND PERMANENT RESIDENTS (GREEN CARD HOLDERS) OF THE UNITED STATES WHO ARE LEGAL RESIDENTS OF ONE OF THE FIFTY STATES, PUERTO RICO, OR THE DISTRICT OF COLUMBIA AND ARE AT LEAST 18 YEARS OF AGE OR THE AGE OF MAJORITY AS DETERMINED BY STATE LAW AS OF THE DATE OF ENTRY. ENTRANTS MAKING A CONTRIBUTION MUST CONFORM TO FEDERAL CONTRIBUTION LIMITATIONS AND PROHIBITIONS AS LISTED ON SPONSOR’S CONTRIBUTION PAGE. DIRECTORS, OFFICERS, NATIONAL CHAIRS, ONGOING CONTRACTORS AND SERVICE PROVIDERS, AND EMPLOYEES OF SPONSOR AND ITS PARTICIPATING COMMITTEES AND AGENTS, OR THE IMMEDIATE FAMILIES OF EACH, ARE NOT ELIGIBLE TO ENTER OR WIN.PARTICIPATION IN THE PROMOTION CONSTITUTES ENTRANT’S FULL AND UNCONDITIONAL AGREEMENT TO THESE OFFICIAL RULES AND TO SPONSOR’S DECISIONS, WHICH ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THE PROMOTION. WINNING A PRIZE IS CONTINGENT UPON FULFILLING ALL REQUIREMENTS SET FORTH HEREIN. SPONSOR RESERVES THE RIGHT TO VERIFY THE ELIGIBILITY OF WINNERS.
  4. ENTRY PERIOD:The Promotion begins on Thursday, February 1st; 2024, at 12:00 am Eastern Time and ends at approximately Sunday, March 24th, 2024, at 11:59 pm Eastern Time. (the “Entry Period”).
  5. HOW TO ENTER:There are two ways to enter the Promotion online:
    • To enter by making a contribution, click here and follow the directions on the contribution page. Make a contribution pursuant to the limitations and prohibitions of federal law, as listed on the contribution page. No minimum contribution is required and making a contribution will not increase your chances of winning.
    • To enter without making a contribution, click here and follow the directions on the free entry page.
    • All entrants and entries are subject to verification by Sponsor. 
  6. DISCLAIMER; ERRORS AND ENTRY PROBLEMS: Sponsor, along with its related committees, candidates, affiliates, directors, members, officers, consultants, professional advisors, employees, and agents (collectively, the “Released Parties”) will not be responsible for: (a) any late, lost, misrouted, garbled or distorted, or damaged transmissions or entries; (b) telephone, electronic, hardware, software, network, Internet, or other computer- or communications-related malfunctions or failures; (c) any Promotion disruptions, injuries, losses or damages caused by events beyond the control of Sponsor or by non-authorized human intervention; or (d) any printing or typographical errors in any materials associated with the Promotion. Only fully completed entries are eligible. Proof of submission will not be deemed to be proof of receipt by Sponsor.
  7. PRIZE DESCRIPTION:One winner and one  guest of the winner’s choosing (subject to the limitations in these rules) will receive the following prize. The Prize includes the following components: 
    • transportation for two (2), made at the discretion of Blackburn Tennessee Victory Fund, within the continental United States to the event location and from winner’s home location, with an approximate retail value of $750
    • one (1) one-night hotel stay at one of the Nashville, TN hotels, with an approximate retail value of $400
    • Two (2) tickets to the Blackburn Tennessee Victory Fund concert with John Rich and Friends, with an approximate retail value of $500
    • and ground transportation at the discretion of Sponsor, with an approximate retail value of $100.
    • The total ARV of the Prize is $1,750. Additional restrictions apply as outlined in these Official Rules.
    • Sponsor will choose, in its sole discretion, the airline, hotel, flight dates, flight times, and airport and other Trip logistics and details. Dates of travel are subject to availability. If the winner’s address is within a reasonable distance of the Destination, Sponsor may, in its sole discretion, provide ground transportation to the Trip hotel or event Destination in lieu of an airplane ticket. Except as expressly set forth in the description of the Trip above, the winner and his or her guest are responsible for ground transportation to and from the airports and hotel, all meals, and all other expenses that such winner and his or her guest incur in connection with the Trip. Sponsor will also determine, in its sole discretion, the date, location, attendees, and all other relevant details of the Trip.
  8. ODDS: The odds of winning the Prize are based on the number of eligible entries received. 
  9. PRIZE RESTRICTIONS: All federal, state, and local taxes associated with the receipt or use of the Prize are the sole responsibility of the winner. The Prize shall be awarded as-is with no warranties of any kind, express or implied (including, without limitation, any warranty of merchantability or fitness for a particular purpose). The Prize is not transferrable. The Prize may not be substituted for cash or any other prize, except that Sponsor may, at its discretion, substitute a prize of equal or greater value.
  10. SELECTION OF WINNER:One potential winner will be chosen by a random drawing from all eligible entries to be held by Sponsor on Monday, March 25th, 2024. Sponsor may, at its sole discretion, conduct a background check on each potential winner. Sponsor reserves the right to disqualify any potential winner from receiving the Prize based on such background check if Sponsor determines, in its sole discretion, that awarding the Prize to such potential winner could result in a safety or security risk to any person or persons or could result in the disruption of any event associated with the Promotion. Sponsor will, in its sole discretion, then select a winner from the list of eligible potential winners on the basis of criteria determined and applied by Sponsor to provide for an appropriate range of views, backgrounds, and interests. The winner will be notified by phone or e-mail no later than Friday, March 29th, 2024. The winner must then identify any potential guest to Sponsor, and Sponsor may, at its option, conduct the same background check and process applicable to potential winners. Sponsor reserves the right to disqualify any potential guest in Sponsor’s sole discretion. In the event that not enough potential winners respond to Sponsor’s attempts to contact them or are otherwise disqualified such that Sponsor is unable to award the Prize, Sponsor may select additional potential winners by random drawing from remaining eligible entries.
  11. IDENTITY OF ENTRANT. In the event of a dispute about the identity of the entrant, entries made online will be declared made by the authorized account holder of the e-mail address submitted at time of entry. An authorized account holder is defined as the natural person who is assigned to an e-mail address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. Each potential winner may be required to provide Sponsor with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry.
  12. CHOICE OF LAW AND FORUM; INTERPRETATIONS; DISPUTES: Entrants agree to be bound by these Official Rules and Sponsor’s interpretation thereof. Except where prohibited, entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion, Official Rules, or the Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by a court of competent jurisdiction in Tennessee; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Entrant submits to sole and exclusive personal jurisdiction to said courts for any matter and irrevocably waives any and all rights to object, challenge, dismiss or transfer such action based on inconvenience of forum or any other reason. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and/or Sponsor in connection with the Promotion will be governed by, and construed in accordance with, the laws of the State of Tennessee, without giving effect to any choice of law or conflict of law rules, which would cause the application of the laws of any other jurisdiction.
  13. CONDITIONS OF PARTICIPATION; LIMITATIONS OF LIABILITY: To the maximum extent permitted by applicable law, by entering this Promotion, entrants agree to be bound by these Official Rules, including all eligibility requirements and the decisions of Sponsor, which are final and binding. Entrants waive all right to, and release and hold harmless, all Release Parties (as defined above) from, any claim, action, injury, liability, loss, damage (including punitive, incidental, and consequential damages), or expense (including attorneys’ fees), including but not limited to, personal injury or death, arising out of or in connection with, directly or indirectly, in whole or in part, their participation in this Promotion or the acceptance, use, or misuse of the Prize. Each winner shall bear all risk of loss or damage to or arising from the winner’s Prize after it has been delivered. Entrants agree that none of the Released Parties have made nor are in any manner responsible or liable for any warranty, representation, or guarantee, statutory, express or implied (including but not limited to, the implied warranties of merchantability, title, and fitness for a particular purpose), in fact or in law, relative to the Promotion or these Official Rules.
  14. VIOLATION OF RULES AND LAW: Entrants who attempt to violate or who are deemed to have, in the sole discretion of Sponsor, violated these Official Rules will be automatically disqualified from the Promotion. Entrants who tamper with Sponsor’s computer or network systems, or other systems, in an attempt to disrupt the Promotion or increase chances of winning, or violate any law governing this Promotion, will be reported to relevant authorities and disqualified.
  15. PUBLICITY RELEASE: EXCEPT WHERE PROHIBITED BY LAW, THE WINNER OF THE PRIZE SHALL GRANT TO SPONSOR AND ITS PARTICIPATING COMMITTEES —WHICH GRANT MAY BE CONFIRMED IN WRITING ON REQUEST OF SPONSOR AND AS AN EXPRESS CONDITION TO RECEIVING THE PRIZE—AND THOSE ACTING PURSUANT TO SPONSOR’S AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING, BUT NOT LIMITED TO, THE WORLD WIDE WEB, AT ANY TIME OR TIMES, EACH WINNER’S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION. 
  16. COPYRIGHTS & TRADEMARKS: Any marks associated with this Promotion are the sole property of Sponsor. Third party marks are property of their respective owners. All Promotion materials, including these Official Rules, are copyrighted works owned by Sponsor.
  17. PRIVACY: Any personal information sent to, shared with, or collected by Sponsor in connection with this Promotion is subject to the Privacy Policy of Sponsor’s authorizing committee: https://www.marshablackburn.com/privacy-policy.
  18. CONSENT TO CALL CELL OR MOBILE PHONE NUMBER: By providing Sponsor with your cell phone or mobile phone number in connection with this Promotion, you are consenting to receive calls and texts, including autodialed and automated calls and texts, to that number with campaign notifications.
  19. REQUESTING OFFICIAL RULES; WINNER’S LIST: TO receive a written copy of the Official Rules, the name of the Promotion winners, or a description of the Prize, please send your request and a self-addressed stamped return envelope to Sponsor at: P.O. Box 3750, Brentwood, TN 37024. Requests must be received no later than Sunday, March 24th, 2024. The winners’ names may be obtained beginning Monday, March 25th, 2024. Vermont residents may omit return postage.
